Pets4Sale makes no representations, or warranties in relation to items sold or listed on the website. All transactions and other contact between members is conducted entirely at the user’s own risk. Pets4Sale makes no claims, representations or guarantees as to the listings or members on this website.
Social Media
Listings content and images may be shared on social media, either by users or Pets4Sale.
Account, Service Provision
It is the User’s responsibility to ensure that the information entered is correct and kept up to date, incorrect information may result in the account being suspended or delayed in setup.
Providing false or misleading information may result in being considered fraudulent in nature and be denied.
Content
The User is responsible for any data/information they upload or store on servers or via systems.
All services provided by Pets4Sale may only be used for lawful purposes and the User agrees to abide by all legal obligations both in New Zealand and Internationally.
The User agrees to not use Pets4Sale’s services for any of the following,
- Illegal activity, (including illegal breeds)
- Infringe on copyright or trademark
- Internet abuse (see Abuse below)
Pets4Sale reserves the right to refuse service, material that, in our judgement, is obscene, threatening, illegal, or violates our terms of service in any manner may be removed from our servers (or otherwise disabled), with or without notice. At the discretion of Pets4Sale, amnesty may be given if the User have a valid reason that the content violation was accidental and has since corrected the breach.
Ad Listings
Listings must be for live animals and for sale (or free) in the knowledge they are in good health. Or should make note of any of the following (but not limited to): injury, old age, rescue, or diagnosed medial condition.
All sellers must be located in New Zealand.
Listings must use own photography and may not use stock images or images taken from other sites.
Listings that don’t comply will be removed or suspended without warning.
Listings where an animals welfare is in question may be removed at the discretion of Pets4Sale.
Communication And Data
All communication and transfer of data through the website may be monitored for security and quality reasons. This includes data submitted through forms and data transferred via the website. In the case of security we may contact parties that are apart of the communication in matters of concern.
Pricing, Plan and Pricing Changes
All prices include GST.
All prices are in New Zealand Dollars (NZD)
Pets4Sale reserves the right to make changes to plans and services, which may include resource allocation or price changes.
Indemnity
You agree to indemnify Pets4Sale against any claim or demand, including reasonable lawyers’ fees, made by any third party due to or arising out of your use of the Services, the breach or violation of this Agreement by you, or the infringement by you, or by any other user of the Services using your computer, of any intellectual property or other right of any person or entity, or as a result of any threatening, libelous, obscene, harassing or offensive material contained in any of your communications.
Legal Compliance
Pets4Sale may disclose any subscriber information to law enforcement agencies without further consent or notification to the subscriber upon lawful request from such agencies. We will cooperate fully with law enforcement agencies.
Force majeure
Neither party shall be liable for any breach of its obligations resulting from causes beyond its reasonable control including fire, natural disaster, war or military hostilities and strikes of its own employees.
Each of the parties agrees to give notice immediately to the other upon becoming aware of an event of force majeure such notice to contain details of the circumstances giving rise to it.
If a default due to force majeure shall continue for more than 4 weeks then the party not in default shall be entitled to terminate this agreement. Neither party shall have any liability to the other in respect of the termination of this agreement as a result of force majeure.
Relationship of parties
Nothing in this agreement shall create a partnership, joint venture or agency or the relationship of employer and employee between us.
Dispute Resolution
In the event of a dispute arising out of or in connection with the terms of this Agreement between you and us, then you agree to attempt to settle the dispute by engaging in good faith with us in a process of mediation before commencing arbitration or litigation.
Jurisdiction
This Contract shall be interpreted according to the Laws of New Zealand and the parties agree to submit to the exclusive jurisdiction of the New Zealand courts. This agreement shall not be governed by the United Nations Convention on Contracts for the International Sale of Goods, the application of which is hereby expressly excluded.
Change to and Revisions of ‘Terms and Conditions’
Pets4Sale reserves the right to change, update, expand or alter Terms and Conditions at anytime without notice.
